Terms of Use and Privacy Policy of ESN Account
The use of ESN Accounts is subject to the Terms of a legal agreement between you and Erasmus Student Network Constanța (hereof referred as “ESN Constanța”). The present document contains the agreement and explains the General Terms. These Terms are referred to below as the “General Terms”. In addition to these, the agreement with ESN Constanța will also include the Terms of any legal notes applicable to the services provided time by time, which are referred to as “Additional Terms”. All the terms are part of the agreement and collectively binding for the user. In case of any contradiction between the “Additional Terms” and “General Terms”, the “Additional Terms” shall take precedence in relation to that service.
Before filling up the forms provided by ESN Constanța in order to use its services, you must read this document and agree to the Terms of Use and Privacy Policy.
Please note that the Terms of Use, as well as the Privacy Policy, may change from time to time. When we change the Terms of Use you will be soon informed. If the Privacy Policy here accepted should change, we will not reduce your rights without your explicit consent. For this purpose, the changes of the Privacy Policy rules will be notified on this page, and the prior versions of the Privacy Police rules will be stored in an archive so that you may review them at any time.
1. Acceptance of the Terms of Use and Privacy Policy
You must accept the Terms by clicking on “accept” or “agree” to the Terms of Use, where this option is made available to you by ESN Constanța in the user interface for any service.
You are suggested to print or save a local copy of the present agreement containing the Terms of Use and Privacy Policy.
2. About the information collected and your privacy.
2.1 We will only collect personal information about you when you register on our platform and when you use our website asset in our Privacy Policy.
2.2 You are not allowed to create an account for anyone other than yourself without permission, as well as to not create more than one personal account profile.
3. Limitations on use.
By using this online platform and its services users confirm they are, at least, 18 (eighteen) years old. Otherwise, users can still use the services of this platform in conjunction with, and under the supervision of, their parent(s) or guardian(s). If you do not qualify, please do not use nor register on ESN Constanța and its services.
Any individual who qualifies to the aforementioned requirements is free to surf through this website as it publicly is. Notwithstanding, only fully registered users with a valid membership from our active Local Section and with an associated role in the platform will be given the rights to full access to the ESN intranet.
ESN services are made available for, and only for, organisational purposes and granting access rights to ESN members and alumni. Users should not use without permission ESN services, or other users where applicable - specially its contact features -, to sell products or services or to increase traffic to another website for commercial reasons such as, but not limited to, sales, promotion or advertising, neither for very personal and/or sensitive purposes and/or misconduct, such as, but again not limited to, disclosing or collecting personal information - with special focus on sensitive information -, harassment and/or informing about non-ESN related topics, among others. Users are not allowed, under any circumstances, to use the search results provided by ESN Constanța in its own intranet or platforms (whether online or offline) , or reuse and display services of ESN or duplicate ESN pages on other websites. If a user wants to incorporate or replicate the services of ESN on another website, he/she must enter into a contract with Erasmus Student Network Constanța and acquire the proper permissions and/or licensing where applicable. To use all or part of ESN services on your own website, please contact us.
4. Content used and disseminated by ESN Accounts
If a user downloads content from ESN Constanța, this user is required to have the rights to use it by any means. This content, including graphics, logos, icons and service names are registered and non-registered trademarks owned by Erasmus Student Network Constanța.
5. Communications.
The users agree that any notice, agreement, disclosure or other communications that we send to them electronically will satisfy any legal communication requirements, including that such communications be in writing.
6. Prohibition of automated queries.
It is forbidden to send automated queries to ESN services or its users without the explicit prior consent of ESN, for the first, and the explicit and properly collected consent or the user, for the later.
7. Liability and Indemnity.
Erasmus Student Network Constanța accepts no liability, particularly related to the accuracy, content, completeness, legality, reliability, or operability or availability of information or material displayed in the results obtained by the ESN services. Erasmus Student Network Constanța accepts no responsibility for the deletion, failure to store, transmit incorrect or inappropriate transmission of such information or data. Erasmus Student Network Constanța accepts no responsibility for any harm resulting from downloading or use of information or data available on the Internet through the services of ESN, neither for any failures, delays or interruptions in these services.
Users agree to indemnify and hold the Erasmus Student Network Constanța and its related members,harmless from and against any third-party claim or cause of action, including reasonable attorneys' fees and court costs, arising, directly or indirectly, out of your use of ESN services or the violation of any law or the rights of any third party by the users of ESN Constanța forms or any third-party providing additional services to the ESN.
8. Content features or links referenced on ESN Constanța web service.
ESN Constanța may receive applications from people who wish to comment, amend, modify or delete certain features or content or links referenced by ESN Constanța forms. Erasmus Student Network Constanța reserves the right to process these requests on a case by case basis. For comments relating to content, links or features, please contact us.
9. Copyright
The content of ESN Constanța web service may include text data and multimedia items (such as texts, drawings, graphics, logos, icons, images, audio and video material, photographs and programmes), which are protected by the provisions of national and international law applying to intellectual property. The textual data and multimedia items are the exclusive property either of ESN International or of their authors. The user must respect the intellectual property rights held by ESN International and third parties, without prejudice to the rights and exceptions provided by any binding provisions. Reproduction of textual data and multimedia items which are the property of ESN Constanța or of third parties and for which the ESN holds the rights of use is authorized for non-commercial purposes only provided that the entire item is reproduced and the source is acknowledged.
Of course, the user undertakes not to delete or change the indications of the author or the source and not to seek to circumvent the technical measures put in place to protect documents and multimedia items, such as print or download restrictions and visible or invisible tagging. Any infringement may lead to civil and criminal proceedings, besides to lead to the removal of the account.

10. Location of the data
The seat of ESN Constanța is ESN Constanța, Str. Unirii nr. 11, Camin C2, et. 4, Constanța, Romania. The data collected by ESN Constanța could be stored in different places and (under contract) by data processors and third parties appointed by us.
11. General
If any provision of these Terms & Conditions is held to be invalid or unenforceable, such provision shall be interpreted in good faith in the minimums needed to make it valid in coherence with the rest of the clauses of this Agreement. Should this not be possible, such provision shall be stuck and the remaining provisions shall be enforced.
Headings are for reference purposes only and in no way, define, limit, construe or describe the extent or scope of such section. Our failure to enforce any provision of these Terms & Conditions shall not constitute a waiver of that or any other provision.
These Terms & Conditions set forth the entire understanding and agreement between you and the Erasmus Student Network Constanța with respect to the subject matter hereof.
12. Responsible body
The “controller” of the processing of your data is the ESN’s Constanța Board.
The data may be treated by some specific “processors” on behalf of the controller as defined in our Privacy Policy

3.1 Personal information submitted to us through our website will be used for the purposes specified in this policy or on the relevant pages of the website.

(a) administer our website and Organisation;
(b) personalise our website for you;
(c) enable your use of the services available on our website;
(d) match you with a good buddy through our website;
(e) send you non-marketing communications about ESN Constanța and its bodies and members;

4.1 We may disclose your personal information to any member of our organization and supporting organisms (this means: our Committees, Project Teams, National Boards, Sections and any other pre-existing or ulteriorly created internal body) insofar as reasonably necessary for the purposes set out in this policy and to guarantee the deliverables of the service offered by the ESN Constanța.
4.2 We may disclose your personal information:
(a) to the extent that we are required to do so by law;
(b) in connection with any ongoing or prospective legal proceedings;
(c) in order to establish, exercise or defend our legal rights (including providing information to others for the purposes of fraud prevention and reducing credit risk);
(d) to any person who we reasonably believe may apply to a court or other competent authority for disclosure of that personal information where, in our reasonable opinion, such court or authority would be reasonably likely to order disclosure of that personal information.
4.3 Except as provided in this policy, we will not provide your personal information to third parties.
4.4 The categories of personal information considered under this Article are the ones defined by Article 2.1 clauses (b), (c), (d), (f) and (g).
4.5 The purposes of the possible disclosure of your personal information as defined in Article 4.5 shall not be different from those mentioned in Article 4.3 and Article 3.2 in clauses (l) and (m) of this document, with the exception of those cases in which the user has previously, actively and expressly provide consent to do so.
5. International data transfers
5.1 Information that we collect may be stored and processed in and transferred between any of the countries in which we or our associate members operate in order to enable us to use the information in accordance with this policy.
5.2 Information that we collect may be transferred to countries which do not have data protection laws equivalent to those in force in the European Economic Area. ESN Constanța cannot guarantee the safety of your data in regards to such transfer.
5.3 You expressly agree to the transfers of personal information described in this Section 5.
6. Retaining personal information
6.1 Section 6 sets out our data retention policies and procedure, which are designed to help ensure that we comply with our legal obligations in relation to the retention and deletion of personal information.
6.2 Personal information that we process for any purpose or purposes shall not be kept for longer than is necessary for that purpose or those purposes.
6.3 Notwithstanding the other provisions of this Section 6, we will retain documents (including electronic documents) containing personal data:
(a) to the extent that we are required to do so by law;
(b) if we believe that the documents may be relevant to any ongoing or prospective legal proceedings; and
(c) in order to establish, exercise or defend our legal rights (including providing information to others for the purposes of fraud prevention and reducing credit risk).
7. Security of personal information
7.1 We will take reasonable technical and organisational precautions to prevent the loss, misuse or alteration of your personal information.
7.2 We will store all the personal information you provide on our secure (password- and firewall-protected) servers.
7.3 You acknowledge that the transmission of information over the internet is inherently insecure, and we cannot guarantee the security of data sent over the internet, nor within the intranet.
7.4 You refuse to held ESN Constanța responsible for the improper or illegal use of your access information as set in clauses 3.2 of this Privacy Policy. It’s the user’s obligation to consider the risks upon submission, management and publication of the user’s personal information on our platform.
8. Amendments
8.1 We may update this policy from time to time by publishing a new version on our website.
8.2 You should check this page occasionally to ensure you are happy with any changes to this policy.
8.3 We may notify you of changes to this policy by email or through a notification system on our website.
9. Your rights
9.1 You may instruct us to provide you with any personal information we hold about you by writing to us; the provision of such information will be subject to the supply of appropriate evidence of your identity. For this purpose, we will usually accept a photocopy of your passport.

9.3 You may instruct us at any time to process or not to process your personal information for marketing purposes.
9.4 In practice, you will usually either expressly agree in advance to our use of your personal information for marketing purposes.
9.5 You have the right to remove your information sent to ESN Constanța and all the information which is stored with it at any given time. You can ask to delete your information provided from ESN Constanța by e-mailing to us.
9.6 When your personal information is deleted, other data linked to it is also deleted.

10.2 We have no control over and are not responsible for, the privacy policies and practices of third parties.
